This paradigm has been completely upended by the spread of Generative Artificial Intelligence (Gen AI). In light of Large Language Models (LLMs) that rely on enormous, opaque datasets, this study contends that consent has evolved into a transactional fiction that fails to uphold individual rights. This study promotes a change from a "consent-based" paradigm to a "control-based" framework using a qualitative policy analysis and comparative legal review. This research attempts to analyze the extent and meticulousness of the participant-rights-based solution of the Indian legal system with respect to the absence of medical treatment and monetary compensation post road traffic incidents. The study adopts a policy-oriented and a doctrinal research approach grounded on Article 21 of the Constitution of India, the Motor Vehicles Act of 1988, recent landmark judgements of the Supreme Court, and contemporary official statistics on road traffic incidents, treatment, and the pending status of claims. This study concludes that the legal system in India has positively and proactively been transformed beyond the age-old framework of a fault-liability system. The Judicial system, as a doctrine, supports the provision of medical treatment and a system of compensation that is both rational and just and that which considers the catastrophic nature of injury, the future of the victim, the provision for prosthetic devices, and the personal health care insurance benefits which will not be deducted. The study, however, maintains that the system, as a model, is still constructively fragmented, and lacks cashless medical treatment, remedies by a tribunal that are significantly compromised by a huge backlog of claims, and compensation that still does not include the costs of rehabilitation in a sufficient or substantial manner. Overall, Indian law has established a significant majority of the normative constructs justifying post-accident compensation. Although the legal system in the field of motor accident compensation has undergone various changes due to amendments in the law and judicial decisions, problems in timely compensation, access to emergency treatment and enforcement of the law remain a hurdle in exercising the rights of the victims. This paper aims to critically analyses the legal and human rights aspects of the claim of the victims of road accidents for compensation and medical assistance in India. It examines the constitutional framework of protection of victims in the context of Article 21 of the Constitution of India, provisions of the Motor Vehicles Act, 1988 as amended in 2019 and judicial interpretations of the scope of the right to life and right to health. The study also examines the operation of Motor Accident Claims Tribunal, the policy of just compensation and the legal duties of the hospitals and public authorities to give prompt medical treatment to accident victims. The paper adopts a doctrinal and analytical research methodology, focusing on the interaction between compensation law, the right to access to justice and international human rights standards. The results show that while there are positive legal advances, there remain procedural bottlenecks, lack of awareness, inconsistencies in victim compensation and gaps in emergency healthcare infrastructure that hinder protection for victims. The paper calls for a rights-based concept that combines the aspects of compensation, medical assistance, human dignity and an overall victim-centric approach in a holistic way. Repeated episodes of communal violence have highlighted serious governance, law enforcement and institutional accountability gaps, leading to grave violations of human rights and social disintegration. This socio-legal study is an attempt to critically examine the nature, causes and consequences of the religious communal violence in India, especially the role and responsibility of the State in the prevention, control and response to religious communal violence. It examines provisions in the constitution, laws, judicial action and policies concerning communal disturbances and victim protection. Using a doctrinal and analytical approach to research, the paper examines key incidents of communal violence and assesses the effectiveness of the current legal frameworks in providing for justice, compensation, rehabilitation and prosecution of offenders. The study also examines the level of compliance of the state agencies, such as the police and the administration, in their constitutional duty to protect fundamental rights and public order. The results show that although India has a comprehensive legal and constitutional framework, state accountability is hindered by ongoing problems with political pressure, slow investigations, poor victim assistance, and poor law enforcement. The paper recommends the need for robust institutional protection, autonomous investigation proceedings, improved victim-centric justice frameworks, and comprehensive laws on communal violence. Access to basic health care service is an issue of inequity for a long time, due to socio-economic disadvantage and disparity in resources across the regions of India. The scheme Ayushman Bharat, launched in 2018, is a game-changer policy intervention to ensure health care services are accessible and financially protected for the marginalised groups and for the achievement of Universal Health Coverage (UHC). In this paper the author discusses the legal, constitutional and policy dimensions of Ayushman Bharat and its potential as a catalyst to increase the access to healthcare as envisioned in Articles 21 and 47 of the Indian Constitution. This analysis appraises the worth of the design, regulatory issues, and results of the plan in enhancing justice in healthcare. It does so, in part, through its analysis of key issues related to infrastructure, funding and supervision of the private sector, and through recommendations to strengthen that ignited framework primarily through the legal formalisation and public governance.
